AGREEMENT BETWEEN CUSTOMER AND TRAVELUTION HOLIDAYS SDN BHD

This website is owned and managed by Travelution Holidays Sdn Bhd (Company Number 202201008908 / 1454605-W). It is designed to help customers gather travel information, check availability, make reservations, and transact with travel suppliers. “Travelution,” “Travelution Holidays,” “we,” “us,” and “our” refer to Travelution Holidays Sdn Bhd. “You, ” “customer,” and “client” refers to visitors to this website or those booking through us via email, live chat, messaging apps (e.g., WhatsApp, Facebook, Instagram), or phone.

By using this website or booking through us, you agree to these Terms and Conditions. If you do not agree, please do not use the site or make bookings with us. We may change these Terms at any time, and continued use signifies acceptance of any updates.

Your agreement with Travelution Holidays starts when we provide written confirmation of your booking via email, messenger, or live chat. Please save or print these Terms for your records.

Price and Payments

Pricing
Prices for products and services are quoted and processed in Malaysian Ringgit (MYR, RM). If quoted in other currencies, the prevailing exchange rate at the time of payment will apply. Prices in other currencies are for reference only and may vary due to exchange rates and any fees charged by your bank or card issuer. For any inquiries regarding fees or exchange rates, please contact your bank or card issuer.

Payment Methods 
Travelution Holidays accepts payments via Visa, Mastercard, and Instant Transfers. Telegraphic transfers and cheque payments are not recommended as they may cause delays that could result in missed payment deadlines with suppliers. Please note, Travelution Holidays does not offer credit facilities.

Deposits
All deposits are non-refundable and must be paid by the specified due date to confirm your booking. During peak season or when space availability is limited, a deposit may be required before a reservation can be made. In such instances, the deposit will be refunded only if the reservation cannot be confirmed. Failure to make the deposit payment by the due date may result in automatic cancellation of your reservation without a refund.

Balance PaymentsThe remaining balance must also be paid by the due date provided. If full payment is not received by this date, your booking may be automatically cancelled by the supplier, and no refunds will be issued.

Service Fees

A minimum service fee of MYR30 per person per booking will apply if the supplier does not pay us a commission. After-hours bookings incur an additional service fee of MYR100. A consultation fee of MYR150 per booking is charged for travel planning, which will be applied toward your reservation if you proceed with us. All service fees are non-refundable. 

Name in Reservations

Reservations must be made in the guest’s name as it appears on their passport. Name changes are not permitted. Guests will be required to present their passport or ID at check-in. If the name on the reservation does not match the passport/ID, a name correction fee may apply, or a new reservation may be required.

Booking Confirmation

Booking confirmation, including service details and pricing, will be sent via email or messenger. If confirmation is not received within 24 hours, please contact Travelution Holidays for assistance.

Booking data in Travelution Holidays’ and/or its suppliers’ systems and website serve as valid proof of bookings and hold the same evidential value as physical documents.

Booking on Behalf of Others

When making a booking on behalf of a group or travel party, the person making the reservations is responsible for ensuring that all participants understand and agree to the terms and conditions outlined on this page. This includes, but is not limited to, passport validity requirements, visa requirements, and other relevant conditions. It is the responsibility of the person booking to communicate all necessary information to the participants to ensure compliance with these terms.

Cancellations

Cancellation of reservations must be made directly with Travelution Holidays.

For full cancellations, suppliers may impose charges or penalties depending on the timing. For partial cancellations, additional charges and a recalculation of the price for the remaining guests may apply (e.g., changing from double to single occupancy).

No-shows will only receive refunds per the supplier’s terms and conditions. 

Travelution Holidays reserves the right to cancel bookings if payment is deemed suspicious or if full payment is not received by the due date.

An administration fee of MYR120 per person will apply, in addition to any supplier fees.

Cancellations – Club Med

    • More than 60 days before check-in: Forfeit deposit
    • 59 to 31 days before check-in: 50% of cost
    • 30 to 15 days before check-in: 70% of cost
    • 14 to 0 days before check-in: 100% of cost

Booking Changes

For voluntary changes to your booking (e.g., travel dates, destination, accommodation), please contact Travelution Holidays. Supplier fees may apply, and an additional administration fee of MYR50 per person will be charged.

Booking Changes – Club Med

    • More than 60 days before check-in: MYR200 per person for changes to name, resort, or date, plus any price difference. The fee is waived if the new booking is more expensive, and you only pay the difference.
    • Within 60 days before check-in: Cancellation charges apply.

Involuntary Changes

Ground and tour operators may make changes to your itinerary due to factors such as weather, natural disasters, traffic, or schedule adjustments. While they strive to maintain the original plan, these changes may affect transportation, activities, destinations, or trip duration. Suppliers may offer alternatives, but no refunds will be provided for changes to the itinerary or affected visits. Travelution Holidays is not liable for any additional costs or inconveniences resulting from these changes.

If airlines make schedule changes, an alternative flight may be offered or a refund may be requested, subject to the airline’s approval.

Refunds

Refunds are subject to the supplier’s terms and conditions. No refunds will be issued for unused airfare, accommodation, meals, sightseeing tours, transport, or any other services included in a package or tour.

Refunds will only be issued after Travelution Holidays receives the amounts from suppliers, which may take up to 6 months. All refunds will be processed in Malaysian Ringgit (MYR) and may be subject to the exchange rate at the time of the refund. Once received from the supplier, the refund amount, minus any applicable fees, will be returned to customers using the original payment method. For cash payments, refunds will be made via online bank transfer.

Restricted Fares

Unless specified otherwise, we assume the customer prefers the lowest-priced services. These services (e.g., “economy class”) may be non-changeable and non-cancellable. They cannot be altered in terms of time, place, or manner from what was originally contracted.

Air Transport Terms and Conditions

The customer is responsible for complying with the instructions of the airline, with respect to flight check-in times. In particular, the customer acknowledges and agrees that:

    • Airlines reserves the right to cancel or change schedules without notice. Schedules shown are based on expected flying times as indicated by the airlines. Because weather and other factors may affect operating conditions, departures and arrivals cannot be guaranteed nor is the responsibility of Travelution Holidays.
    • Travelution Holidays has no control over the allocation of seats on any air transport, even if pre-booked with the airline, it does not guarantee that specific seats will be available on departure.
    • Travelution Holidays has no control over any indications of the hours spent flying which are provided by the supplier of the relevant air transport and are given for guidance only and are subject to alteration and confirmation.
    • It is the customer’s responsibility to confirm his / her flight in accordance with the requirements of the supplier of the relevant air transport.
    • Customer must use flight coupons in sequence. The airline may cancel without refund any onward or return flights if customer does not show up for any flight booked.
    • In the case of special or charter flights, the name of the airline, the flight schedule, the aircraft type, the itinerary and possible intermediate stops are only given as an indication of the outward and return flights in the trip. In accordance with a supplier’s rules and restrictions, these flights, aircraft types and flight numbers can be subject to change and can be moved at any time, even after confirmation.
    • Additional charges may be imposed by airlines for meals, luggage, seat selection, etc. The customer is responsible for checking ticket inclusions before travel. Travelution Holidays is not responsible for these charges. The airlines may amend the charges at any time.
    • Customer must comply with all air transport supplier’s rules and restrictions on the carriage of pregnant women.
    • Airlines reserves the right to assess additional charges that could include an additional ticket purchase for passengers who may be too large to comfortably sit in one seat.
    • Customers must comply with the air transport supplier’s rules and restrictions on the carriage of children and that children older than 2 years on the return date must have a return ticket at a child fare for both the outbound and inbound flights. Customers who do not comply with this will not be eligible for a refund of any seat charges incurred during travel. Children under 2 years will not be allocated their own seat in the aircraft unless a child ticket has been booked for them. Unaccompanied children under fourteen will only be carried in accordance with the air transport Supplier’s Rules and Restrictions.

Combined One-Way Tickets

Travelution Holidays may offer combined tickets for one-way or roundtrip travel, which can provide more flight options and potential savings. Each ticket is subject to its own rules, restrictions, and fees.

If an airline changes a flight (e.g., cancellation or rescheduling) and you need to alter another flight, you will be responsible for any fees associated with changes to the unaffected flight.

Travel Documents and Entry Requirements

You are responsible for ensuring that your travel documents, including passport validity and visas (transit, business, tourist, etc.), meet the entry requirements of your destinations. Travelution Holidays does not have specialised knowledge regarding these requirements and strongly urges customers to review travel advisories issued by relevant governments before booking. We are not liable for any issues arising from your failure to comply.

Health
Recommended vaccinations and health requirements may change. Consult your doctor for current recommendations and ensure you meet all health entry requirements. Follow all medical advice related to your trip.

Disinfection
Countries may disinfect aircraft if there is a perceived public health threat. Approved procedures include spraying cabins with insecticides while passengers are on board or treating surfaces when passengers are not present.

Passport Validity
Passports must be valid for at least six (6) months beyond the last destination’s departure date. If your passport is within 1 year of expiration, verify the requirements before finalising travel plans. The name on your passport must match the name on your ticket to avoid travel issues and potential insurance invalidation.

Visa Requirements
For visa information, contact the embassy of your transit and destination country. Visa processing can take time, so apply well in advance and check for any updates before booking. We accept no liability for entry refusals due to incorrect or inadequate travel documents, including during transit.

Travel Risks
While most travel occurs without incident, certain destinations may pose higher risks. We advise passengers to review travel prohibitions, warnings, and advisories from Wisma Putra before booking international trips.

Special Fares

Special fares may offer lower prices but may not be the most direct route and could involve changing aircraft. A direct flight means no aircraft change, though there may be stops for refueling or passenger changes. Details of any stops will be provided during booking and in the confirmation email. Frequent flyer miles or class upgrades may not apply to special fares.

Airline Auxiliary Charges

Passengers may incur additional charges for airline services such as seat selection, meals, drinks, internet, lounge access, priority boarding, and other optional extras. These charges are not included in the base fare and are subject to the policies of the individual airline. It is the passenger’s responsibility to review and accept these charges during the booking process or at the time of travel. Travelution Holidays is not responsible for any fees associated with these services, and any disputes regarding auxiliary charges must be resolved directly with the airline.

Check-In Luggage

Airlines may charge extra for additional, overweight, or non-standard luggage. Non-standard items include sporting equipment (e.g., golf clubs, skis), tools, musical instruments, large trunks, boxes, and car seats. Animal transportation require advance reservations and may incur additional handling charges.

Airline Liability

Airlines’ liability for death, personal injury, and other damages is generally limited by national law, international treaties, or the airline’s own rules and conditions of carriage.

Electronic ticket

An electronic ticket has no physical form. Customers can check in online, at the airline’s desk or kiosk, and must present valid travel documents (passport, visa, ID) to obtain their boarding pass. It is essential to adhere to check-in and gate closure times. It is recommended to print a copy of your itinerary or e-ticket for immigration purposes.

Operating airlines

Flights booked with one airline may be operated by another (codeshare or wet lease). Advance seat reservations, online check-in, and frequent flyer benefits may not be available.

Denied Boarding Compensation

If an airline cancels or delays a flight, fails to provide confirmed space, skips a stop-over or destination, or causes a missed connection, the customer may be entitled to remedies from the airline.

Accommodation Services

Accommodation may be booked separately or as part of a package and is subject to the supplier’s rules and restrictions, including cancellation and change fees.

Full payment is required for hotel bookings unless stated otherwise. Prices do not include optional fees such as for laundry, minibar, room service, or phone calls.

If you miss the first night but plan to stay for the remaining nights, you must confirm with Travelution Holidays by the original check-in date to avoid cancellation of the entire reservation. Failure to confirm may result in cancellation and refunds according to the supplier’s policies.

Reservations must be cancelled or changed before the hotel’s cancellation policy period to avoid charges. Some hotels do not allow changes or cancellations after booking, as indicated in their rules and restrictions.

Use of rooms

Rooms are generally available after 3pm on check-in day and must be vacated by 10am-12pm on check-out day, depending on the hotel. Early check-in or late check-out may be available for an additional charge.

Single rooms have one bed and may incur a supplement. Double rooms usually feature either two single beds or one double bed.

Accommodation Star Ratings

Star ratings are general guidelines and may not reflect official local standards. Hotel quality can vary between countries and even within the same country. A 3-star hotel in one country may not be equivalent to a 3-star hotel elsewhere.

Accommodation Images

While we strive to keep property images and descriptions on Travelution Holidays accurate, we cannot guarantee their precision as they are provided by travel suppliers. Images and descriptions are for general reference only.

Room images may not reflect the exact bed configuration of your booked room. For example, a triple room in North America might have one double and one single bed, while a double room in Austria might have two single beds. Additional charges may apply for extra beds or baby cots.

Accommodation Activities

Activities offered by suppliers may be canceled due to weather, unforeseen circumstances, out-of-season conditions, or insufficient participants. For sightseeing, the sequence of attractions is indicative and may be altered by the suppliers at any time.

Accommodation Meals

Meals included in an accommodation package depend on the number of overnight stays. Full board typically includes breakfast, lunch, and dinner, while half board includes breakfast and either lunch or dinner. Meals start with dinner on the arrival day and end with breakfast (half board) or lunch (full board) on departure. No refunds are given for unused meals.

Drinks are generally not included with meals unless stated otherwise. If drinking water is not provided, customers must purchase it themselves. Parents should bring special baby food, as it may not be available locally.

Accommodation Taxes

Local authorities may impose additional taxes (e.g., tourist, heritage, green tax) that must be paid directly by the customer. Tax rates may change between booking and stay, and any increases will be the customer’s responsibility.

Car Hire

Car hire services may be booked separately or as part of a package and are subject to the rental company’s rules and restrictions.

For “Supplier Special Rate” bookings, Travelution Holidays acts as an intermediary. While we collect payment from customers, the amount may not reflect the full rental price due to possible contributions by Travelution Holidays. Any refunds will be limited to the amount actually paid by the customer.

Car Hire – Method of payment

The customer must present a credit card (not a debit card) when collecting the vehicle. Check with the supplier for accepted credit cards. The supplier may place a deposit authorization on the credit card. Ensure your card limit is sufficient by contacting your card company.

Failure to meet these requirements may result in the vehicle not being provided, and the full rental price will be charged.

Car Hire – Supplements

Additional charges may apply locally, including for refueling, extra drivers, young driver surcharges, and delivery/collection fees. Travelution Holidays and suppliers are not liable for these charges.

An excess may apply for theft or damage, varying by supplier and country. Optional local insurance (e.g., super CDW) can reduce this excess. Travelution Holidays and suppliers are not liable for these excesses or additional insurance.

Petrol is generally not included. In some countries, suppliers may charge for refueling or snow tires.

The vehicle should be returned to the original branch unless otherwise agreed. A one-way supplement may apply if not returned as specified.

Child seats are available on request and are payable locally.

Collection/Use of the Vehicle

Drivers typically must be between 21 and 65, though this varies by supplier and country. Additional charges may apply for drivers under 30.

Drivers must present a valid driving license for the vehicle category, held for at least one year. An international driving permit may be required. Check specific rules before collecting the vehicle.

Some suppliers restrict vehicle use to the rental country. No refunds are provided for unused rental days.

Travel Insurance

Travel insurance is not included unless stated otherwise. The customer is therefore advised to take out insurance that covers the consequences of certain cases of cancellation and that also provides cover for certain special risks such as the cost of repatriation in the event of an accident or illness. It is the customer’s responsibility to ensure any insurance policy taken out is adequate to cover their requirements.

The risks covered by these policies, as well as the cost and the amount of cover, are for the purpose of illustration. If a policy is bought, the insurer will send the policy to the customer. Claims must be submitted directly to the insurance company in accordance with the terms and conditions of the policy.

Visa Application Service

Travelution Holidays facilitates visa applications through third-party service providers. We act solely as an intermediary and are not responsible for any issues or delays caused by these third parties.

Visa Expiry

The validity of your visa is subject to the visa expiry date or the expiration date of your passport, whichever comes first. Ensure your passport is valid for the required period as specified by the visa authorities.

Visa Application –  Third-Party Services

The visa application process is facilitated through third-party services, including but not limited to runner services. Travelution Holidays is not liable for any actions or omissions of these third parties.

Visa Application –  Accuracy

It is the customer’s responsibility to provide accurate and complete information for the visa application. Travelution Holidays will assist in the application process, but we are not liable for any errors or omissions in the application that may affect visa issuance.

Visa Application – Processing Time

Visa processing times are determined by the relevant authorities and may vary. Travelution Holidays cannot guarantee specific processing times and is not responsible for any delays or additional costs incurred.

Visa Application – Fees and Charges

All fees related to the visa application, including those charged by third parties, are the customer’s responsibility. Travelution Holidays will provide a breakdown of fees, but any additional charges imposed by visa authorities or third parties are not within our control.

Visa Application –  Refunds and Cancellations

Fees paid for visa applications are non-refundable, even if the visa application is denied or if there are changes in travel plans.

Visa Application – Documentation

Customers are required to submit all necessary documents as specified by the visa authorities. Failure to provide the required documentation may result in delays or refusal of the visa application.

Right to Reject

Suppliers reserve the right to cancel or withdraw any itinerary or booking, or to refuse service to any person whose presence may endanger the health, safety, or comfort of others. If a carrier, hotel, or service provider denies access for any reason, Travelution Holidays’ sole liability is to refund the passenger any amounts paid, minus costs for services already used, administrative fees, cancellation charges, and other deductions in accordance with the suppliers’ refund policies.

Responsibility

Travelution Holidays and its agents act solely as intermediaries for passengers and transportation providers, including airlines, car rental companies, hotels, and other service suppliers.

Exclusion of Liability

Travelution Holidays is not liable for any typographical errors in the information, products, or services provided. All suppliers are independent contractors, and we are not responsible for their actions, errors, or negligence, including any personal injuries or damages that may occur.

We will not issue refunds or compensation for delays, cancellations, overbookings, strikes, Force Majeure events, or any other circumstances beyond our control, including government actions.

Travelution Holidays and its suppliers are not liable for any direct, indirect, or consequential damages, except in cases of willful misconduct. Claims must be submitted in writing within 30 days after travel completion.

Disclaimer

Travelution Holidays and its agents are not responsible for any injury, illness, damage, loss, or irregularities affecting persons or property. Transportation companies are exempt from liability for any incidents occurring when passengers are not on board. We do not accept liability for events beyond our control, including but not limited to war, civil unrest, natural disasters, or machinery failures.

All disputes are subject to Malaysian law. These terms cannot be altered or waived without written consent. For any claims, Travelution Holidays will provide assistance as needed.

We comply with the Personal Data Protection Act 2010 (PDPA) regarding the collection and use of your personal data, which is provided voluntarily with your consent.

We reserve the right to amend these terms without prior notice. It is your responsibility to review any changes. Continued use of our services signifies acceptance of the revised terms.
